Recientemente, la C\u00e1mara Federal de Apelaciones de Paran\u00e1 declar\u00f3 la inconstitucionalidad del decreto 70\/2023 en varios art\u00edculos de esta norma, en particular los art\u00edculos 267 y 269, obligando a OSDE a revertir los aumentos en las cuotas que aplic\u00f3 desde enero.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Decreto 70\/2023 y sus Implicaciones<\/h2>\n\n\n\n<p>El Decreto 70\/2023 desregul\u00f3 una serie de normativas en el sector salud, permitiendo a las empresas de medicina prepaga establecer libremente sus precios. Sin embargo, este cambio legislativo ha generado importantes cuestionamientos. Gabriel Oriolo, Superintendente de Servicios de Salud (SSS), rest\u00f3 importancia a la decisi\u00f3n judicial al aclarar que el Estado no es parte en el proceso y que, por lo tanto, la resoluci\u00f3n no afectar\u00eda a todos los afiliados, sino \u00fanicamente al caso particular.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">La Decisi\u00f3n de la C\u00e1mara Federal<\/h2>\n\n\n\n<p>El juicio fue presentado por un particular y la Asociaci\u00f3n de Defensa de los Derechos de los Usuarios y Consumidores (Adduc), quienes argumentaron que los aumentos no se ajustaban a la Constituci\u00f3n. La C\u00e1mara Federal dio la raz\u00f3n a los demandantes, y su fallo implica que la regulaci\u00f3n previa de la cuota debe mantenerse.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Implicaciones para los Afiliados<\/h3>\n\n\n\n<p>La resoluci\u00f3n plante\u00f3 una serie de interrogantes para los afiliados. La C\u00e1mara devolvi\u00f3 a la SSS la autoridad para autorizar y revisar los valores de las cuotas, lo que significa que las empresas de medicina prepaga como OSDE deber\u00e1n ajustar sus precios nuevamente, tomando en cuenta los par\u00e1metros definidos por la ley 26.682.<\/p>\n\n\n\n<p>Sin embargo, el cumplimiento de la sentencia enfrenta desaf\u00edos, ya que el Estado nacional no fue parte en el juicio, lo que podr\u00eda complicar la implementaci\u00f3n de la medida. En caso de que OSDE decida acatar el fallo, tendr\u00eda que solicitar a la SSS que retome su anterior jurisdicci\u00f3n, un proceso que no puede ser gestionado por una parte demandada, sino solo por la Justicia.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Futuro de las Cuotas de OSDE<\/h2>\n\n\n\n<p>Los abogados de OSDE probablemente recurrir\u00e1n a la Corte Suprema mediante un recurso extraordinario. Solo si el expediente es aceptado se podr\u00e1 decidir sobre el fondo del asunto. La incertidumbre prevalece, ya que se desconoce qu\u00e9 tipo de actualizaci\u00f3n se aplicar\u00e1 y si la SSS mantendr\u00e1 el sistema actual, ajustando las cuotas seg\u00fan los costos de las empresas.<\/p>\n\n\n\n<p>El caso se torna complejo no solo por las implicaciones legales, sino tambi\u00e9n por el efecto directo en los 1400 afiliados representados por la asociaci\u00f3n demandante.
