Sin embargo, en Argentina, miles de afiliados enfrentan la<strong> baja de la prepaga en jubilacion <\/strong> o aumentos forzados de plan justo cuando m\u00e1s necesitan atenci\u00f3n, vi\u00e9ndose obligados a litigar para mantener sus derechos adquiridos.<\/p>\n\n<p class=\"wp-block-paragraph\">La transici\u00f3n de trabajador activo a jubilado no deber\u00eda implicar la p\u00e9rdida de derechos adquiridos. Pero en la pr\u00e1ctica, muchas empresas de medicina prepaga aplican criterios administrativos que dejan al afiliado en una situaci\u00f3n de vulnerabilidad extrema.<\/p>\n\n<p class=\"wp-block-paragraph\">El caso resuelto por el Juzgado Civil y Comercial Federal N.\u00ba 11, marca l\u00edmites claros a las decisiones arbitrarias de las prestadoras de salud.<\/p>\n\n<h2>EL PASE AUTOMATICO A PAMI<\/h2>\n\n<p class=\"wp-block-paragraph\">Una de las pr\u00e1cticas m\u00e1s comunes es asumir que, al jubilarse, el afiliado pasa autom\u00e1ticamente a PAMI.<\/p>\n\n<p class=\"wp-block-paragraph\">Esto es falso.<\/p>\n\n<p class=\"wp-block-paragraph\">La normativa argentina reconoce el derecho de opci\u00f3n del beneficiario. Es decir, el afiliado puede elegir continuar con su prepaga o derivar aportes a otra obra social.<\/p>\n\n<p class=\"wp-block-paragraph\">En el caso analizado, las empresas involucradas intentaron justificar la baja bas\u00e1ndose en esta supuesta afiliaci\u00f3n autom\u00e1tica. La justicia fue clara:<br \/>\ud83d\udc49 Nadie puede obligarte a cambiar de cobertura sin tu consentimiento.<\/p>\n\n<h2>Derecho a la continuidad: clave para jubilados<\/h2>\n\n<p class=\"wp-block-paragraph\">El fallo refuerza un principio central: la jubilaci\u00f3n no extingue el v\u00ednculo con la prepaga.<\/p>\n\n<p class=\"wp-block-paragraph\">El tribunal orden\u00f3:<br \/>\u2022 Mantener las mismas prestaciones<br \/>\u2022 Conservar la afiliaci\u00f3n dentro del grupo familiar<br \/>\u2022 Reconocer los aportes retenidos por ANSES<\/p>\n\n<p class=\"wp-block-paragraph\">Esto frena una pr\u00e1ctica habitual: obligar al jubilado a pasar a un plan individual mucho m\u00e1s caro.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>La urgencia m\u00e9dica no espera<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Cuando hay enfermedades cr\u00f3nicas, como tratamientos de hemodi\u00e1lisis, el factor tiempo es cr\u00edtico.<\/p>\n\n<p class=\"wp-block-paragraph\">El juez aplic\u00f3 una medida cautelar, priorizando el derecho a la vida por sobre cualquier discusi\u00f3n contractual.<\/p>\n\n<p class=\"wp-block-paragraph\">Este criterio est\u00e1 alineado con la jurisprudencia de la Corte Suprema de Justicia de la Naci\u00f3n Argentina, que ha sostenido reiteradamente que:<\/p>\n\n<p class=\"wp-block-paragraph\">El derecho a la salud est\u00e1 directamente vinculado con el derecho a la vida.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>C\u00f3mo deben circular los aportes<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">El fallo tambi\u00e9n resolvi\u00f3 un punto clave: el circuito financiero.<br \/>\u2022 ANSES transfiere aportes<br \/>\u2022 La obra social intermedia los deriva<br \/>\u2022 La prepaga los recibe como pago parcial<br \/>\u2022 El afiliado solo paga la diferencia<\/p>\n\n<p class=\"wp-block-paragraph\">Esto evita que las empresas ignoren los aportes previsionales para justificar aumentos o bajas.<\/p>\n\n<p class=\"wp-block-paragraph\">Las leyes que te protegen<\/p>\n\n<p class=\"wp-block-paragraph\">Este precedente se apoya en normas vigentes:<br \/>\u2022 <a href=\"https:\/\/servicios.infoleg.gob.ar\/infolegInternet\/anexos\/0-4999\/62\/texact.htm\">Ley 23.660<\/a><br \/>\ud83d\udc49 Regula el funcionamiento de las obras sociales y garantiza la continuidad del afiliado.<br \/><a href=\"https:\/\/servicios.infoleg.gob.ar\/infolegInternet\/anexos\/180000-184999\/182180\/texact.htm\">\u2022 Ley 26.682<\/a><br \/>\ud83d\udc49 Establece derechos de los usuarios y l\u00edmites a las empresas.<\/p>\n\n<p class=\"wp-block-paragraph\">Conclusi\u00f3n: un precedente que cambia las reglas<\/p>\n\n<p>\u00a0<\/p>\n\n<p class=\"wp-block-paragraph\">Este fallo deja algo claro:<br \/>\ud83d\udc49 Las prepagas no pueden darte de baja por jubilarte.<\/p>\n\n<p class=\"wp-block-paragraph\">La salud no es un servicio m\u00e1s. Tiene una funci\u00f3n social que la ley protege, especialmente en la etapa m\u00e1s vulnerable de la vida.<\/p>\n\n<p class=\"wp-block-paragraph\">Si te encontr\u00e1s en esta situaci\u00f3n, ten\u00e9s herramientas legales para defenderte.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Clave para el afiliado:<\/strong> Si est\u00e1s enfrentando esta situaci\u00f3n, no firmes ninguna baja ni aceptes planes &#8220;especiales para jubilados&#8221;
