class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\n<p>Cumplir a\u00f1os no puede convertirse en una penalidad econ\u00f3mica. Sin embargo, eso fue exactamente lo que ocurri\u00f3 con <a id=\"https:\/\/www.iprofesional.com\/legales\/418249-fallo-por-que-osde-debera-devolverle-plata-a-afiliado\" href=\"https:\/\/www.iprofesional.com\/legales\/418249-fallo-por-que-osde-debera-devolverle-plata-a-afiliado\" type=\"link\">un afiliado de OSDE que, al alcanzar los 36 a\u00f1os<\/a>, recibi\u00f3 una notificaci\u00f3n informando un aumento de su cuota mensual por \u201ccambio de categor\u00eda etaria\u201d.<\/p>\n\n<p>No era un ajuste general autorizado por inflaci\u00f3n. Era un incremento individual por edad. Y la Justicia lo declar\u00f3 ileg\u00edtimo.<\/p>\n\n<p>La Sala B de la C\u00e1mara Nacional de Apelaciones en lo Comercial confirm\u00f3 la condena contra OSDE y orden\u00f3 devolver todo lo cobrado en exceso, con intereses y costas.<\/p>\n\n<p>La pregunta de fondo es clara: <strong>\u00bfpuede una prepaga aumentar la cuota solo porque el afiliado cumple a\u00f1os?<\/strong><\/p>\n\n<p>La respuesta, seg\u00fan este fallo, es no.<\/p>\n\n<h2 class=\"wp-block-heading\">\u00bfEs legal que una prepaga aumente la cuota por cumplir a\u00f1os?<\/h2>\n\n<p>El eje del caso estuvo en determinar si el aumento por rango etario estaba permitido por la normativa vigente.<\/p>\n\n<p>La C\u00e1mara entendi\u00f3 que la medicina prepaga no es un contrato comercial com\u00fan. Es un servicio esencial vinculado al derecho a la salud, donde el afiliado se encuentra en situaci\u00f3n de vulnerabilidad estructural.<\/p>\n\n<p>Permitir aumentos autom\u00e1ticos por edad rompe el equilibrio contractual y traslada unilateralmente el mayor riesgo al consumidor.<\/p>\n\n<h2 class=\"wp-block-heading\">Qu\u00e9 dice la Ley 26.682 sobre el rango etario<\/h2>\n\n<p>La Ley 26.682, que regula la medicina prepaga en Argentina, no autoriza incrementos autom\u00e1ticos exclusivamente basados en la edad del afiliado.<\/p>\n\n<p>El sistema establece que los aumentos generales deben ser autorizados por la Superintendencia de Servicios de Salud (SSSN). No habilita ajustes individuales discrecionales por cambio de franja etaria una vez vigente el contrato.<\/p>\n\n<p>El fallo fue contundente: OSDE no acredit\u00f3 que el afiliado hubiera prestado consentimiento informado y documentado aceptando ese mecanismo.<\/p>\n\n<p>Sin prueba contractual v\u00e1lida, el \u201ccambio de categor\u00eda\u201d se transforma en una modificaci\u00f3n unilateral prohibida.<\/p>\n\n<h2 class=\"wp-block-heading\">\u201cCambio de categor\u00eda\u201d vs. aumento encubierto<\/h2>\n\n<p>La defensa de OSDE intent\u00f3 sostener que no exist\u00eda un aumento arbitrario, sino una readecuaci\u00f3n prevista contractualmente.<\/p>\n\n<p>Pero en derecho no importa c\u00f3mo se lo denomine. Importa si est\u00e1 probado y si es legal.<\/p>\n\n<p>La C\u00e1mara rechaz\u00f3 el argumento porque la empresa no present\u00f3 documentaci\u00f3n que demostrara que el afiliado acept\u00f3 expresamente esa cl\u00e1usula al contratar.<\/p>\n\n<p>Sin contrato claro, no hay regla v\u00e1lida. Y sin regla v\u00e1lida, hay abuso.<\/p>\n\n<h2 class=\"wp-block-heading\">Devoluci\u00f3n del dinero e intereses: qu\u00e9 debe pagar OSDE<\/h2>\n\n<p>El fallo no se limit\u00f3 a declarar ileg\u00edtimo el incremento.<\/p>\n\n<p>Orden\u00f3:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Reintegrar todos los importes cobrados de m\u00e1s desde diciembre de 2022<\/li>\n\n<li>Pagar los intereses correspondientes<\/li>\n\n<li>Asumir las costas del juicio<\/li>\n\n<li>Readecuar la cuota al valor que debi\u00f3 haberse abonado sin el aumento por edad<\/li>\n<\/ul>\n\n<p>Adem\u00e1s, dej\u00f3 en claro que cualquier incremento futuro deber\u00e1 estar autorizado por la SSSN, \u00fanico organismo con competencia legal para validar aumentos generales.<\/p>\n\n<p>Esto no es simb\u00f3lico. Es dinero concreto que debe volver al bolsillo del afiliado.<\/p>\n\n<h2 class=\"wp-block-heading\">Por qu\u00e9 no se aplic\u00f3 da\u00f1o punitivo<\/h2>\n\n<p>Aunque la conducta fue considerada ileg\u00edtima, el tribunal no impuso da\u00f1o punitivo.<\/p>\n\n<p>Los jueces entendieron que no se acredit\u00f3 mala fe ni intenci\u00f3n deliberada de da\u00f1ar al afiliado. Para aplicar sanciones ejemplificadoras bajo la Ley de Defensa del Consumidor se requiere probar un comportamiento especialmente grave o malicioso.<\/p>\n\n<p>Aqu\u00ed se reconoci\u00f3 el cobro indebido, pero no una conducta sistem\u00e1tica de castigo o desprecio hacia el consumidor.<\/p>\n\n<h2 class=\"wp-block-heading\">Qu\u00e9 deben revisar hoy los afiliados a prepagas<\/h2>\n\n<p>Este fallo deja un mensaje claro: las prepagas no tienen libertad absoluta para modificar cuotas por edad.<\/p>\n\n<p>Si en tu factura aparece:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>\u201cCambio de categor\u00eda\u201d<\/li>\n\n<li>\u201cReadecuaci\u00f3n por rango etario\u201d<\/li>\n\n<li>Incremento individual distinto del aumento general autorizado<\/li>\n<\/ul>\n\n<p>Conviene revisar el contrato original y verificar si existe respaldo normativo y autorizaci\u00f3n estatal.<\/p>\n\n<p>Muchos afiliados pagan aumentos por desconocimiento. Y el desconocimiento es el terreno donde prosperan estas pr\u00e1cticas.<\/p>\n\n<h2 class=\"wp-block-heading\">Conclusi\u00f3n<\/h2>\n\n<p>La Justicia volvi\u00f3 a marcar un l\u00edmite: cumplir a\u00f1os no puede ser motivo autom\u00e1tico de encarecimiento unilateral del servicio.<\/p>\n\n<p>El aumento por edad en OSDE fue declarado ileg\u00edtimo y deber\u00e1 devolverse lo cobrado de m\u00e1s. Sin embargo, eso fue exactamente lo que ocurri\u00f3 con un afiliado de OSDE que, al alcanzar los 36 a\u00f1os, recibi\u00f3 una notificaci\u00f3n informando un aumento de su cuota mensual por \u201ccambio de categor\u00eda etaria\u201d. No era un ajuste general autorizado por inflaci\u00f3n. Era un incremento individual por edad. Y la Justicia lo declar\u00f3 ileg\u00edtimo. La Sala B de la C\u00e1mara Nacional de Apelaciones en lo Comercial confirm\u00f3 la condena contra OSDE y orden\u00f3 devolver todo lo cobrado en exceso, con intereses y costas. La pregunta de fondo es clara: \u00bfpuede una prepaga aumentar la cuota solo porque el afiliado cumple a\u00f1os? La respuesta, seg\u00fan este fallo, es no. \u00bfEs legal que una prepaga aumente la cuota por cumplir a\u00f1os? El eje del caso estuvo en determinar si el aumento por rango etario estaba permitido por la normativa vigente. La C\u00e1mara entendi\u00f3 que la medicina prepaga no es un contrato comercial com\u00fan. Es un servicio esencial vinculado al derecho a la salud, donde el afiliado se encuentra en situaci\u00f3n de vulnerabilidad estructural. Permitir aumentos autom\u00e1ticos por edad rompe el equilibrio contractual y traslada unilateralmente el mayor riesgo al consumidor. Qu\u00e9 dice la Ley 26.682 sobre el rango etario La Ley 26.682, que regula la medicina prepaga en Argentina, no autoriza incrementos autom\u00e1ticos exclusivamente basados en la edad del afiliado. El sistema establece que los aumentos generales deben ser autorizados por la Superintendencia de Servicios de Salud (SSSN). No habilita ajustes individuales discrecionales por cambio de franja etaria una vez vigente el contrato. El fallo fue contundente: OSDE no acredit\u00f3 que el afiliado hubiera prestado consentimiento informado y documentado aceptando ese mecanismo. Sin prueba contractual v\u00e1lida, el \u201ccambio de categor\u00eda\u201d se transforma en una modificaci\u00f3n unilateral prohibida. \u201cCambio de categor\u00eda\u201d vs. aumento encubierto La defensa de OSDE intent\u00f3 sostener que no exist\u00eda un aumento arbitrario, sino una readecuaci\u00f3n prevista contractualmente. Pero en derecho no importa c\u00f3mo se lo denomine. Importa si est\u00e1 probado y si es legal. La C\u00e1mara rechaz\u00f3 el argumento porque la empresa no present\u00f3 documentaci\u00f3n que demostrara que el afiliado acept\u00f3 expresamente esa cl\u00e1usula al contratar. Sin contrato claro, no hay regla v\u00e1lida. Y sin regla v\u00e1lida, hay abuso. Devoluci\u00f3n del dinero e intereses: qu\u00e9 debe pagar OSDE El fallo no se limit\u00f3 a declarar ileg\u00edtimo el incremento. Orden\u00f3: Adem\u00e1s, dej\u00f3 en claro que cualquier incremento futuro deber\u00e1 estar autorizado por la SSSN, \u00fanico organismo con competencia legal para validar aumentos generales. Esto no es simb\u00f3lico. Es dinero concreto que debe volver al bolsillo del afiliado. Por qu\u00e9 no se aplic\u00f3 da\u00f1o punitivo Aunque la conducta fue considerada ileg\u00edtima, el tribunal no impuso da\u00f1o punitivo. Los jueces entendieron que no se acredit\u00f3 mala fe ni intenci\u00f3n deliberada de da\u00f1ar al afiliado. Para aplicar sanciones ejemplificadoras bajo la Ley de Defensa del Consumidor se requiere probar un comportamiento especialmente grave o malicioso. Aqu\u00ed se reconoci\u00f3 el cobro indebido, pero no una conducta sistem\u00e1tica de castigo o desprecio hacia el consumidor. Qu\u00e9 deben revisar hoy los afiliados a prepagas Este fallo deja un mensaje claro: las prepagas no tienen libertad absoluta para modificar cuotas por edad. Si en tu factura aparece: Conviene revisar el contrato original y verificar si existe respaldo normativo y autorizaci\u00f3n estatal. Muchos afiliados pagan aumentos por desconocimiento. Y el desconocimiento es el terreno donde prosperan estas pr\u00e1cticas. Conclusi\u00f3n La Justicia volvi\u00f3 a marcar un l\u00edmite: cumplir a\u00f1os no puede ser motivo autom\u00e1tico de encarecimiento unilateral del servicio. El aumento por edad en OSDE fue declarado ileg\u00edtimo y deber\u00e1 devolverse lo cobrado de m\u00e1s. La regulaci\u00f3n existe, el control estatal tambi\u00e9n, y el contrato no puede alterarse sin consentimiento v\u00e1lido.
