class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\n<p>En este post analizamos los <strong>aumentos por rango etario no autorizados<\/strong>\u00a0aplicados en el <strong>Galeno Plan 220<\/strong>, especialmente en el salto de la franja 37\u201364 a\u00f1os a 65\u2013100 a\u00f1os. Nuestro estudio est\u00e1 recibiendo consultas de afiliados que detectan incrementos abruptos al cumplir 65 a\u00f1os y quieren saber si el <strong>Galeno Plan 220 aumento por rango etario<\/strong>\u00a0es legal o puede ser impugnado mediante un amparo de salud.<\/p>\n\n<p>La ley permite escalas por edad. Lo que no permite son aumentos desproporcionados, discriminatorios o que violen los l\u00edmites normativos.<\/p>\n\n<p>Normativa aplicable:<br \/><a href=\"https:\/\/www.argentina.gob.ar\/normativa\/nacional\/ley-26682\">Ley 26682<\/a><\/p>\n<p>Autoridad de control:<br \/><a href=\"https:\/\/www.argentina.gob.ar\/sssalud\"><u>https:\/\/www.argentina.gob.ar\/sssalud<\/u><\/a><\/p>\n\n<h1 class=\"wp-block-heading\"><strong>Qu\u00e9 muestran las escalas del Galeno Plan 220<\/strong><\/h1>\n\n<p>En el cuadro tarifario del Plan 220 (modalidad directo y desregulado) se observan diferencias marcadas entre franjas etarias:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>0\u201325 a\u00f1os<\/li>\n\n<li>26\u201336 a\u00f1os<\/li>\n\n<li>37\u201364 a\u00f1os<\/li>\n\n<li>65\u2013100 a\u00f1os<\/li>\n<\/ul>\n\n<p>El salto entre 37\u201364 y 65\u2013100 a\u00f1os pr\u00e1cticamente duplica el valor en algunos casos.<\/p>\n\n<p>La pregunta jur\u00eddica no es si puede existir diferencia. La pregunta es si esa diferencia respeta los l\u00edmites de la Ley 26.682.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>Qu\u00e9 dice la ley sobre aumentos por rango etario<\/strong><\/h1>\n\n<p>La Ley 26.682 establece dos reglas clave:<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>1\ufe0f\u20e3 Regla del 3 a 1<\/strong><\/h3>\n\n<p>La cuota m\u00e1s alta no puede superar tres veces la cuota de la franja m\u00e1s joven.<\/p>\n\n<h3 class=\"wp-block-heading\"><strong>2\ufe0f\u20e3 Protecci\u00f3n mayores de 65 con m\u00e1s de 10 a\u00f1os de antig\u00fcedad<\/strong><\/h3>\n\n<p>Si el afiliado tiene m\u00e1s de 65 a\u00f1os y m\u00e1s de 10 a\u00f1os en la misma prepaga, no puede aplicarse un aumento exclusivamente por edad.<\/p>\n\n<p>Si el <strong>Galeno Plan 220 aumento por rango etario<\/strong>\u00a0supera esos par\u00e1metros, puede existir ilegalidad.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>Cotejo pr\u00e1ctico: diferencia entre 37\u201364 y 65\u2013100 a\u00f1os<\/strong><\/h1>\n\n<p>En el cuadro observado:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Franja 37\u201364: aproximadamente $333.197<\/li>\n\n<li>Franja 65\u2013100: aproximadamente $652.519<\/li>\n<\/ul>\n\n<p>El incremento supera el 90%.<\/p>\n\n<p><strong>Con esos valores, NO respeta la regla 3 a 1.<\/strong><\/p>\n\n<p>La diferencia supera ampliamente el l\u00edmite legal.<\/p>\n\n<p>El an\u00e1lisis jur\u00eddico debe responder:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>\u00bfRespeta el tope 3 a 1 respecto de la franja 0\u201325?<\/li>\n\n<li>\u00bfEl afiliado tiene antig\u00fcedad mayor a 10 a\u00f1os?<\/li>\n\n<li>\u00bfEl aumento fue debidamente notificado?<\/li>\n\n<li>\u00bfEst\u00e1 autorizado por la autoridad de aplicaci\u00f3n?<\/li>\n<\/ul>\n\n<p>No todo aumento es autom\u00e1ticamente ilegal. Pero tampoco es autom\u00e1ticamente v\u00e1lido.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>Cu\u00e1ndo el aumento puede ser considerado no autorizado<\/strong><\/h1>\n\n<p>Un aumento por rango etario puede ser impugnado cuando:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Viola la regla 3 a 1<\/li>\n\n<li>Se aplica a mayores con protecci\u00f3n por antig\u00fcedad<\/li>\n\n<li>No fue notificado con 30 d\u00edas de anticipaci\u00f3n<\/li>\n\n<li>Resulta confiscatorio o expulsivo<\/li>\n\n<li>No cuenta con respaldo administrativo<\/li>\n<\/ul>\n\n<p>En esos casos, corresponde evaluar un <strong>amparo de salud<\/strong>.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>Por qu\u00e9 el amparo es la v\u00eda adecuada<\/strong><\/h1>\n\n<p>El amparo de salud es un proceso r\u00e1pido que permite:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Suspender el aumento<\/li>\n\n<li>Retrotraer valores<\/li>\n\n<li>Garantizar continuidad de cobertura<\/li>\n<\/ul>\n\n<p>Los tribunales federales han intervenido reiteradamente cuando las subas por edad comprometen el derecho constitucional a la salud.<\/p>\n\n<p>Cuando el <strong>Galeno Plan 220 aumento por rango etario<\/strong>\u00a0pone en riesgo la permanencia del afiliado en el sistema, el camino judicial es viable.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Analisis caso real afiliado Galeno Plan Azul 220 aumento por rango etario indebido<\/strong><\/h2>\n\n<p>Un caso reciente que lleg\u00f3 a nuestro estudio refleja con claridad la magnitud del problema.<\/p>\n\n<p>La afiliada abonaba una <strong>cuota de $ 450.000 <\/strong>y, tras el cambio de franja etaria, recibi\u00f3 una liquidaci\u00f3n por <strong>$1.300.000<\/strong>\u00a0lo que implic\u00f3 un <strong>incremento de $ 850.000<\/strong>, equivalente a un <strong>65% de aumento<\/strong>\u00a0aplicado exclusivamente por edad. Este tipo de salto tarifario no puede analizarse de manera autom\u00e1tica ni asumirse como v\u00e1lido por el solo hecho de estar previsto en una escala etaria.<\/p>\n\n<p>Cuando el impacto econ\u00f3mico es de tal magnitud que compromete la continuidad en el sistema, corresponde verificar si respeta la Ley 26.682, el l\u00edmite de proporcionalidad y las condiciones de notificaci\u00f3n, ya que un aumento de estas caracter\u00edsticas puede ser susceptible de impugnaci\u00f3n mediante amparo de salud.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>Qu\u00e9 deben hacer los afiliados de Galeno<\/strong><\/h1>\n\n<p>Si recibiste un aumento por cambio de franja etaria:<\/p>\n\n<ol class=\"wp-block-list\">\n<li>Verific\u00e1 tu antig\u00fcedad.<\/li>\n\n<li>Guard\u00e1 las facturas previas.<\/li>\n\n<li>Solicit\u00e1 el cuadro tarifario completo.<\/li>\n\n<li>Control\u00e1 fecha de notificaci\u00f3n.<\/li>\n\n<li>Consult\u00e1 inmediatamente por un amparo si el salto es abrupto.<\/li>\n<\/ol>\n\n<p>El tiempo es clave. Si se deja pasar, el aumento se consolida.<\/p>\n\n<h1 class=\"wp-block-heading\"><strong>Conclusi\u00f3n:<\/strong><\/h1>\n\n<p>El <strong>Galeno Plan 220 aumento por rango etario<\/strong>\u00a0debe analizarse caso por caso. La ley permite escalas por edad, pero impone l\u00edmites claros para evitar abusos.<\/p>\n\n<p>Cuando la diferencia entre 37\u201364 y 65\u2013100 a\u00f1os se vuelve desproporcionada o afecta afiliados con antig\u00fcedad protegida, el aumento puede ser revisado judicialmente.<\/p>\n\n<p>Los afiliados de Galeno no est\u00e1n obligados a aceptar incrementos que vulneren la normativa vigente. Nuestro estudio est\u00e1 recibiendo consultas de afiliados que detectan incrementos abruptos al cumplir 65 a\u00f1os y quieren saber si el Galeno Plan 220 aumento por rango etario\u00a0es legal o puede ser impugnado mediante un amparo de salud. La ley permite escalas por edad. Lo que no permite son aumentos desproporcionados, discriminatorios o que violen los l\u00edmites normativos. La pregunta jur\u00eddica no es si puede existir diferencia. La pregunta es si esa diferencia respeta los l\u00edmites de la Ley 26.682. Qu\u00e9 dice la ley sobre aumentos por rango etario La Ley 26.682 establece dos reglas clave: 1\ufe0f\u20e3 Regla del 3 a 1 La cuota m\u00e1s alta no puede superar tres veces la cuota de la franja m\u00e1s joven. 2\ufe0f\u20e3 Protecci\u00f3n mayores de 65 con m\u00e1s de 10 a\u00f1os de antig\u00fcedad Si el afiliado tiene m\u00e1s de 65 a\u00f1os y m\u00e1s de 10 a\u00f1os en la misma prepaga, no puede aplicarse un aumento exclusivamente por edad. Si el Galeno Plan 220 aumento por rango etario\u00a0supera esos par\u00e1metros, puede existir ilegalidad. Cotejo pr\u00e1ctico: diferencia entre 37\u201364 y 65\u2013100 a\u00f1os En el cuadro observado: El incremento supera el 90%. Con esos valores, NO respeta la regla 3 a 1. La diferencia supera ampliamente el l\u00edmite legal. El an\u00e1lisis jur\u00eddico debe responder: No todo aumento es autom\u00e1ticamente ilegal. Pero tampoco es autom\u00e1ticamente v\u00e1lido. Cu\u00e1ndo el aumento puede ser considerado no autorizado Un aumento por rango etario puede ser impugnado cuando: En esos casos, corresponde evaluar un amparo de salud. Por qu\u00e9 el amparo es la v\u00eda adecuada El amparo de salud es un proceso r\u00e1pido que permite: Los tribunales federales han intervenido reiteradamente cuando las subas por edad comprometen el derecho constitucional a la salud. Cuando el Galeno Plan 220 aumento por rango etario\u00a0pone en riesgo la permanencia del afiliado en el sistema, el camino judicial es viable. Analisis caso real afiliado Galeno Plan Azul 220 aumento por rango etario indebido Un caso reciente que lleg\u00f3 a nuestro estudio refleja con claridad la magnitud del problema. La afiliada abonaba una cuota de $ 450.000 y, tras el cambio de franja etaria, recibi\u00f3 una liquidaci\u00f3n por $1.300.000\u00a0lo que implic\u00f3 un incremento de $ 850.000, equivalente a un 65% de aumento\u00a0aplicado exclusivamente por edad. Este tipo de salto tarifario no puede analizarse de manera autom\u00e1tica ni asumirse como v\u00e1lido por el solo hecho de estar previsto en una escala etaria. Cuando el impacto econ\u00f3mico es de tal magnitud que compromete la continuidad en el sistema, corresponde verificar si respeta la Ley 26.682, el l\u00edmite de proporcionalidad y las condiciones de notificaci\u00f3n, ya que un aumento de estas caracter\u00edsticas puede ser susceptible de impugnaci\u00f3n mediante amparo de salud. Qu\u00e9 deben hacer los afiliados de Galeno Si recibiste un aumento por cambio de franja etaria: El tiempo es clave. Si se deja pasar, el aumento se consolida. Conclusi\u00f3n: El Galeno Plan 220 aumento por rango etario\u00a0debe analizarse caso por caso. La ley permite escalas por edad, pero impone l\u00edmites claros para evitar abusos.
