de medicina privada, especialmente en grandes centros urbanos como CABA, Gran Buenos Aires, C\u00f3rdoba y Rosario. Las subas por encima de la inflaci\u00f3n, sin justificaci\u00f3n clara y con impacto directo en el derecho a la salud, dieron lugar a miles de reclamos administrativos y judiciales.<\/p>\n\n<p>En este contexto, el <strong>amparo por aumento de prepaga<\/strong> aparece como la herramienta m\u00e1s eficaz para frenar incrementos desmedidos cuando afectan a familias, jubilados y trabajadores en cada jurisdicci\u00f3n.<\/p>\n\n<h2 class=\"wp-block-heading\">\u00bfCu\u00e1ndo un aumento de la prepaga es ilegal en Argentina?<\/h2>\n\n<p>No todo aumento es autom\u00e1ticamente ilegal. El problema surge cuando el incremento:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>No est\u00e1 debidamente informado ni desglosado<\/li>\n\n<li>Resulta desproporcionado frente a la inflaci\u00f3n y salarios<\/li>\n\n<li>Afecta a adultos mayores o personas con enfermedades preexistentes<\/li>\n\n<li>Viola el principio de razonabilidad<\/li>\n\n<li>Compromete el acceso continuo al servicio de salud<\/li>\n<\/ul>\n\n<p>La <strong>Ley 26.682<\/strong> establece que las empresas de medicina prepaga est\u00e1n sujetas al control estatal y deben respetar criterios de razonabilidad y proporcionalidad en sus aumentos.<\/p>\n\n<h2 class=\"wp-block-heading\">Amparo por aumento de prepaga en Argentina: cu\u00e1ndo procede y d\u00f3nde iniciar el reclamo<\/h2>\n\n<p>El <strong>amparo por aumento de prepaga<\/strong> procede cuando existe una lesi\u00f3n actual o inminente a derechos constitucionales, especialmente el derecho a la salud y a la vida.<\/p>\n\n<p>Los jueces suelen admitir el amparo por aumento de prepaga cuando:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>El aumento impide pagar la cuota<\/li>\n\n<li>No existe otra v\u00eda judicial m\u00e1s r\u00e1pida<\/li>\n\n<li>El da\u00f1o es grave y urgente<\/li>\n<\/ul>\n\n<p>En muchos casos se ordena mantener la cuota anterior o aplicar aumentos limitados hasta que se resuelva el fondo del asunto.<\/p>\n\n<h2 class=\"wp-block-heading\">Fallos recientes sobre aumento de prepagas en Argentina<\/h2>\n\n<p>La jurisprudencia es mayoritariamente favorable a los usuarios. Los tribunales han sostenido que:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>La salud no puede quedar librada a reglas puramente comerciales<\/li>\n\n<li>Las prepagas cumplen una funci\u00f3n social<\/li>\n\n<li>Los aumentos deben ser controlables y razonables<\/li>\n<\/ul>\n\n<p>La Corte Suprema ha reiterado que el derecho a la salud es un derecho fundamental impl\u00edcito en la Constituci\u00f3n Nacional.<\/p>\n\n<h2 class=\"wp-block-heading\">Amparo por aumento de prepaga en adultos mayores y jubilados<\/h2>\n\n<p>Los aumentos de prepaga en personas mayores de 60 a\u00f1os reciben un control judicial m\u00e1s estricto.
