un incremento de la cuota de tu plan de medicina prepaga, este art\u00edculo es para vos.<\/p>\n\n<p class=\"has-medium-font-size\">Desde enero 2024 el escenario regulatorio cambi\u00f3 tras el Decreto de Necesidad y Urgencia n.\u00ba 70\/2023 (DNU 70\/2023) y en el fuero federal de San Mart\u00edn (Provincia de Buenos Aires) se resolvieron amparos de salud favorables a los afiliados de esta prepaga.<\/p>\n\n<p class=\"has-medium-font-size\">Aqu\u00ed encontrar\u00e1s qu\u00e9 cambi\u00f3, qu\u00e9 resoluciones hay, y qu\u00e9 pasos puedes dar. <br \/>Y para asesoramiento legal especializado: <a href=\"http:\/\/www.estudiomma.com.ar\">www.estudiomma.com.ar.<\/a> o en <a href=\"https:\/\/aumentoprepaga.com.ar\/?elementor_library=contacto-2\">aumentoprepagas<\/a><\/p>\n\n<p>\u00a0<\/p>\n\n<h2 class=\"wp-block-heading\">1) \u00bfQu\u00e9 cambi\u00f3 con el DNU 70\/2023 y por qu\u00e9 los aumentos?<\/h2>\n\n<p class=\"has-medium-font-size\">El DNU 70\/2023 modific\u00f3 el r\u00e9gimen de regulaci\u00f3n del sistema de medicina prepaga, reduciendo o modificando ciertas facultades de fiscalizaci\u00f3n de la Superintendencia de Servicios de Salud.<\/p>\n\n<p class=\"has-medium-font-size\">Como resultado, muchas prepagas \u2014incluida Cobermed\u2014 aplicaron aumentos de cuota m\u00e1s altos que la inflacion o con mayor frecuencia.<br \/>Ese cambio abri\u00f3 la puerta a reclamos porque para muchos afiliados el incremento result\u00f3 desproporcionado en relaci\u00f3n con sus ingresos o la estructura del plan.<\/p>\n\n<h2 class=\"wp-block-heading\">2) \u00bfCu\u00e1ndo y cu\u00e1nto aument\u00f3 para afiliados de Cobermed\/Cober?<\/h2>\n\n<p class=\"has-medium-font-size\">Aunque los montos concretos var\u00edan plan por plan, varios informes se\u00f1alan que entre enero 2024 a octubre 2025 los ajustes fueron elevados de hasta el 700 % o m\u00e1s para ciertos planes. Es decir que se multiplico por siete el valor del plan, cuando la inflacion de este mismo periodo fue del 99% segun los datos del INDEC.<\/p>\n\n<p class=\"has-medium-font-size\">Si eres afiliado de Cobermed\/Cober y viste un salto importante en esa fecha, es probable que el ajuste se haya visto influido por la nueva regulaci\u00f3n del DNU 70\/2023.<\/p>\n\n<h2 class=\"wp-block-heading\">3) Amparos judiciales en San Mart\u00edn: \u00bfqu\u00e9 se ha resuelto?<\/h2>\n\n<p class=\"has-medium-font-size\">En el fuero federal de San Mart\u00edn se tramitaron y resolvieron amparos de salud dirigidos contra la aplicaci\u00f3n de aumentos de cuota de prepagas (entre ellas Cobermed\/Cober) y ordeno a la prepaga a que proceda a la facturaci\u00f3n de las cuotas de afiliaci\u00f3n en principio sobre el valor de la cuota de diciembre de 2023 -ello sin perjuicio que la demandada acredite otro monto vigente a esa fecha de conformidad con lo dispuesto en el decreto 743\/22 o el acuerdo de congelamiento de<br \/>precios por 90 d\u00edas arribado para el \u00faltimo trimestre de 2023-, efectuando sobre los siguientes periodos los ajustes mensuales que resulten de aplicarle el \u00cdndice Precios al Consumidor que publica el INDEC, a partir de enero del corriente a\u00f1o y de forma acumulativa respecto del \u00faltimo valor actualizado; en el caso de que existan sumas en favor de los actores, deber\u00e1n ser tomadas como pagos a cuenta sobre futuras cuotas. Finalmente, la accionada deber\u00e1 abstenerse de cualquier acto que importe en el caso, la suspensi\u00f3n y\/o interrupci\u00f3n de los servicios contratados por la actora.<\/p>\n\n<p class=\"has-medium-font-size\">Los puntos clave de las decisiones suelen ser:<br \/>\u2022 Reconocimiento del derecho a la salud como un derecho protegido constitucionalmente.<br \/>\u2022 Aplicaci\u00f3n de medida cautelar para suspender el aumento en forma provisoria hasta que se eval\u00fae su justificaci\u00f3n.<br \/>\u2022 Evaluaci\u00f3n de la proporcionalidad del aumento frente a la vulnerabilidad del afiliado (por ejemplo personas con discapacidad o enfermedades cr\u00f3nicas).<br \/>\u2022 Cuestionamiento de que la empresa de medicina prepaga haya justificado adecuadamente sus incrementos.<\/p>\n\n<p class=\"has-medium-font-size\">Por ejemplo, hay un fallo que orden\u00f3 a Cobermed que no aplicara un aumento de cuota para la cobertura de una menor con discapacidad, <a href=\"https:\/\/www.infobae.com\/judiciales\/2024\/03\/09\/la-justicia-le-ordeno-a-una-prepaga-no-aumentar-la-cuota-de-la-cobertura-de-una-menor-con-discapacidad\/\">hasta tanto se acredite el fundamento del aumento<\/a>.<\/p>\n\n<p>\u2e3b<\/p>\n\n<h2 class=\"wp-block-heading\">4) \u00bfQu\u00e9 significa esto para vos como afiliado de Cobermed\/Cober?<\/h2>\n\n<p class=\"has-medium-font-size\"><br \/>\u2022 Si te llegaron aumentos y consider\u00e1s que es desproporcionado o injustificado, est\u00e1s en condiciones de iniciar un reclamo o un amparo.<br \/>\u2022 En casos de vulnerabilidad sanitaria (ni\u00f1os, discapacidad, enfermedades graves) los tribunales han sido particularmente sensibles a otorgar medidas cautelares.<br \/>\u2022 No todos los casos son iguales: los fallos favorables funcionan para quienes acreditan el da\u00f1o o riesgo al derecho a la salud, pero no implican autom\u00e1ticamente que todos los aumentos sean nulos para todos los afiliados.<\/p>\n\n<h2 class=\"wp-block-heading\">5) Qu\u00e9 pasos concretos pod\u00e9s seguir<\/h2>\n\n<p class=\"has-medium-font-size\"><br \/>1. Revisar la notificaci\u00f3n de aumento de cuota: fecha, porcentaje, motivo.<br \/>2. Verificar tu condici\u00f3n (discapacidad, enfermedad cr\u00f3nica, etc.) que pueda reforzar tu posici\u00f3n.<br \/>3. No es necesario hacer un reclamo formal a Cobermed\/Cober y a la Superintendencia de Servicios de Salud v\u00eda su web o por escrito, dejando constancia.<br \/>4. Si corresponde, iniciar una acci\u00f3n de amparo ante el fuero federal que incluya una medida cautelar para suspender la aplicaci\u00f3n del aumento hasta que se resuelva de fondo.<\/p>\n\n<p>\u00a0<\/p>\n\n<h2 class=\"wp-block-heading\">6) \u00bfCu\u00e1les son los riesgos o l\u00edmites de estos amparos?<\/h2>\n\n<p class=\"has-medium-font-size\"><br \/>\u2022 Aunque existan fallos favorables, estos suelen tener efecto limitado al caso particular, no autom\u00e1ticamente a todo el universo de afiliados de Cobermed\/Cober.<br \/>\u2022 Algunas decisiones est\u00e1n en apelaci\u00f3n o tr\u00e1mite, por lo que la resoluci\u00f3n definitiva puede tardar.<\/p>\n\n<h2 class=\"wp-block-heading\">7) Conclusi\u00f3n<\/h2>\n\n<p class=\"has-medium-font-size\">Si sos afiliado a Cobermed\/Cober y viste un aumento de cuota desde enero 2024, este es un buen momento para revisar tu situaci\u00f3n.<\/p>\n\n<p class=\"has-medium-font-size\">Gracias a los fallos del fuero federal de San Mart\u00edn, ten\u00e9s una v\u00eda real de defensa de tus derechos.
